These Terms and Conditions set out the basis on which Waste Clearance Waterloo provides waste clearance and related services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing us to carry out any waste collection or clearance, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, organisation or other entity requesting or receiving the services from Waste Clearance Waterloo.
Services means any waste clearance, rubbish removal, bulky waste collection, recycling, or related work carried out by Waste Clearance Waterloo.
Waste means any items, materials, rubbish or refuse to be removed as part of the services, including household, commercial and recyclable materials, but excluding any prohibited or hazardous materials as set out in these terms or in applicable law.
Agreement means the contract between Waste Clearance Waterloo and the customer, comprising these Terms and Conditions together with any written or verbal quotation accepted by the customer.
Waste Clearance Waterloo provides on-demand and pre-booked waste clearance services, including but not limited to domestic rubbish removal, commercial waste collection, builder waste removal, garden waste clearance, and general waste collection.
The specific scope of the services for each booking will be as described in the quotation or booking confirmation. The services are limited to the removal of waste agreed at the time of booking and reasonably accessible at the premises.
We reserve the right, at our discretion, to decline to remove any waste that is unsafe to handle, prohibited by law, incorrectly described, or substantially different in volume or nature from that described at the time of booking.
Customers may request services by telephone, email, or online enquiry. A booking is only confirmed when Waste Clearance Waterloo has provided a quotation and the customer has accepted it, and when we have confirmed the agreed date and time window for the collection.
Quotations are based on the information supplied by the customer regarding the type and amount of waste, location, access, and any special requirements. Quotations are normally provided as an estimate and may be adjusted on site if the actual waste differs from the description provided.
The customer must ensure that all information supplied during the booking process is accurate, complete and not misleading. If on arrival we find that the waste differs significantly in volume, weight, composition or accessibility from the information provided, we may revise the price, alter the scope of the services, or decline the job.
Any time or date for the services is given in good faith but is not guaranteed. We will make reasonable efforts to attend within the agreed time window, but we are not liable for delays caused by traffic, accidents, road closures, weather, or other circumstances beyond our reasonable control.
The customer must ensure that our staff have safe and reasonable access to the waste at the scheduled time. This includes providing any necessary access codes, keys, parking permissions or permits, and ensuring that common areas and internal routes are clear and safe.
If adequate access is not available when we arrive, we may charge a call-out fee or reasonable waiting time, or treat the visit as a cancellation or aborted job. The customer is responsible for any parking charges, congestion charges or access fees reasonably incurred in carrying out the services.
The customer must ensure that waste is presented in a safe manner, free from sharp objects protruding from bags or containers, and that any loose materials are contained where reasonably possible. The customer must inform us in advance of any items that may present particular health and safety risks.
Our charges are based on factors including volume of waste, weight, type of materials, loading time, and access conditions. Prices will be communicated to the customer in the quotation or on-site assessment before the services are carried out, except where otherwise agreed.
Unless otherwise agreed in writing, payment is due in full on completion of the services. We may require a deposit at the time of booking, particularly for larger collections or commercial work. Deposits may be non-refundable in accordance with the cancellation terms in these conditions.
We accept common payment methods such as cash, major debit or credit cards, and approved bank transfers. Where the customer is a business or organisation and credit terms have been agreed in writing, invoices must be paid within the time stated on the invoice.
Failure to pay any amount due may result in interest being charged at the statutory rate applicable under UK law, together with any reasonable costs incurred in recovering the debt, including legal and enforcement costs where applicable.
The customer may cancel or reschedule a booking by providing reasonable notice before the scheduled arrival time. We ask for at least 24 hours notice for standard bookings. Where less notice is given, we reserve the right to charge a reasonable cancellation fee or to retain any deposit paid.
If we arrive at the premises and are unable to carry out the services due to lack of access, incorrect address details, absence of an authorised person where required, or because the waste is not available as described, we may treat the job as an aborted visit. In such cases we reserve the right to charge a call-out fee and reasonable costs incurred.
Waste Clearance Waterloo may cancel or reschedule a booking due to circumstances beyond our reasonable control, including severe weather, staff illness, vehicle breakdown, or safety concerns. Where possible, we will inform the customer as soon as we become aware of any such issues and will offer an alternative time or date. Our liability in such cases is limited to rescheduling or refunding any amounts paid for services not delivered.
We handle general household and commercial rubbish, furniture, appliances, garden waste, light construction waste, and recyclable materials. All waste is handled and transferred in accordance with applicable UK waste regulations and duty of care requirements.
Certain items cannot be collected or require special arrangements. These may include, but are not limited to, hazardous waste, chemicals, solvents, oils, asbestos, medical waste, clinical waste, gas cylinders, explosives, and any materials classified as dangerous goods. The customer must inform us in advance if any waste may fall within restricted categories.
We reserve the right to refuse removal of any item that is unsafe, illegal to transport, or not in accordance with our licence or insurance conditions. If prohibited or hazardous materials are discovered during loading, we may suspend the services until the issue is resolved, revise the price to reflect specialist handling, or remove only the compliant waste.
Waste Clearance Waterloo operates in accordance with UK waste legislation and environmental regulations. We will take all reasonable steps to ensure that waste collected from customers is transported, treated and disposed of at authorised facilities and, where practicable, sent for reuse or recycling.
Where required, Waste Clearance Waterloo will hold the relevant waste carrier registration and will comply with the duty of care in relation to controlled waste. We may issue appropriate documentation or receipts to confirm that waste has been collected, and customers are advised to retain such records for their own compliance purposes.
The customer is responsible for ensuring that any waste presented is lawfully theirs to dispose of and does not infringe any third party rights. By engaging our services, the customer confirms that they have authority to transfer the waste to us and to permit us to remove it from the premises.
We will exercise reasonable care and skill in providing the services. However, our liability to the customer is limited as set out in this section.
We are not liable for any loss or damage arising from inaccurate information provided by the customer, lack of access, unsafe conditions at the premises, or any failure of the customer to comply with these terms. We are not responsible for items that the customer intended to retain but which were not clearly separated from the waste or were mixed in with materials identified for removal.
Except in relation to death or personal injury caused by our negligence, or any other liability which cannot be limited or excluded under UK law, our total liability to the customer for any loss or damage arising out of or in connection with the services or the agreement shall be limited to the total price paid or payable for the services in respect of the particular job giving rise to the claim.
We are not liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or loss of data. We are not responsible for pre-existing defects, damage or wear and tear at the premises or to fixtures and fittings.
The customer is responsible for securing or protecting any surfaces, fixtures or items that may be vulnerable to damage during the normal course of waste removal, such as delicate flooring, walls, or fittings. We will take reasonable care when removing bulky items, but minor scuffs or marks may be unavoidable in confined spaces and are not considered negligence.
The customer must remove and keep safe any valuable or personal items from areas where we will be working. We do not accept responsibility for valuables that are not removed prior to the commencement of the services.
The customer is responsible for clearly identifying which items are to be removed and which are to remain. Our staff will act on the instructions given at the time of collection and will not be liable for the removal of items that were not clearly indicated as being excluded from the waste.
Waste Clearance Waterloo will maintain appropriate public liability insurance and, where applicable, employer liability insurance to cover the provision of the services. Details of insurance cover are available on request.
We collect and process customer information as necessary to manage bookings, deliver the services, handle payments, and comply with our legal obligations. This may include contact details, service addresses, and information relating to specific waste collection requirements.
Customer data will be stored securely and only retained for as long as reasonably necessary. We will not sell customer information to third parties. We may share information with service partners, payment providers or authorities where this is necessary for providing the services, processing payments or fulfilling legal obligations.
If the customer is dissatisfied with any aspect of the services, they should contact Waste Clearance Waterloo as soon as reasonably possible, providing details of the issue and any supporting information. We will investigate and aim to resolve complaints promptly and fairly.
Where a dispute cannot be resolved directly, both parties agree to consider reasonable forms of alternative dispute resolution before commencing formal legal proceedings, without affecting either party's right to seek relief from a court where appropriate.
Waste Clearance Waterloo may update or amend these Terms and Conditions from time to time to reflect changes in the law, industry practice or our operations. The version in force at the time of booking will govern the services for that booking. Customers are encouraged to review the latest terms whenever making a new booking.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the agreement or the provision of our waste clearance services.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be severed from the remaining provisions, which will continue to be valid and enforceable.
No failure or delay by Waste Clearance Waterloo in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.
The agreement is between Waste Clearance Waterloo and the customer. No other person shall have any rights to enforce any of its terms.
By proceeding with a booking, the customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions in relation to all waste collection and clearance services undertaken by Waste Clearance Waterloo.
